What is informed consent?

Informed consent describes the exchange of certain information between doctor and patient. The physician is required to discuss with a patient his or her condition and suggested treatment options. Once the patient has a clear understanding of the circumstances, he or she must usually sign an informed consent form, which gives the physician permission to treat in the proposed manner.

If the physician fails to receive informed consent from a patient and administers treatment anyway, then malpractice has been performed.
