Parents sue oral surgeon for daughter’s death

Parents of a 17 year-old girl who died while getting her wisdom teeth removed have sued the oral surgeon and anesthesiologist for wrongful death.

The teen’s parents say the surgeon and anesthesiologist were negligent when they failed to resuscitate their daughter after seeing her heart rate and blood oxygen levels drop. The state chief medical examiner ruled her cause of death hypoxia, or oxygen deprivation.

Her parents hope to inform other families’ about the risks of wisdom teeth surgery and the need for medical staff to have better emergency training.

Common problems with the surgery include permanent nerve damage resulting in numbness of the lips, cheeks, and tongue. Other complications can include jaw fractures, brain tissue infections, and life-threatening hypoxia and bleeding.

Diagnostic tests most likely to prompt medical malpractice suits

According to a study conducted by researchers at the State University of New York Downstate Medical Center, physicians that often order diagnostic tests are more likely to be sued for medical malpractice.

The study, which will be published in the Journal of the American College of Radiology, saw that patients sue diagnosticians due to a break down in communication. Issues like patients and physicians not receiving test results, long turnaround times for test results, and delayed reports of findings are a major cause of medical malpractice lawsuits.

Researchers found that between 1996 and 2003, malpractice payments based on diagnosis rose nearly 40%. From 1991 to 2010, payments rose from $21.7 million to $91 million.

NJ high school’s third consecutive undefeated season

Ramsey, New Jersey’s Don Bosco Preparatory High School welcomed its third consecutive undefeated football season this year and stayed in the number one national spot all season.

This year marked the school’s record sixth consecutive NJSIAA Non-Public A title as well as its record sixth straight Star-Ledger Top 20 Trophy. It goes without saying that Don Bosco Prep is the number one school in the state. The school has won a total of eight Star-Ledger Top 20 Trophies.

Senior defensive end, Darius Hamilton, is ranked number two in the nation and had more than twenty-five scholarship offers before the 2011 season even started.

Name mix-up results in delayed diagnosis of cancer

A 59 year-old woman went in for her annual mammogram and gynecological exam a few years ago and was told her Pap smear was normal, but didn’t hear back about her mammogram. Thinking that no news was good news, she thought nothing of it.

The next year she went in, her physician asked why she hadn’t come in the year before since her files did not contain mammogram results. It turned out that her doctor had the same last name as an orthopedic surgeon at the same medical center. Her files sat on his desk for a year and showed that she had breast cancer.

The cancer had spread to her chest wall and she underwent chemotherapy and radiation, but still had to have a lumpectomy and a mastectomy. She filed a lawsuit against the medical center and was awarded an undisclosed settlement.

Conrad Murray sentenced to prison time

Michael Jackson’s physician, Conrad Murray, has been sentenced to four years in prison, the maximum sentence, for  involuntary manslaughter. However, due to overcrowding and budget problems with the California prison system, he will only serve two years.

Jackson died in 2009 of a fatal overdose of propofol, a tranquilizer not approved for use as a sedative. Prosecutors argued that Murray acted recklessly without regard to the singer’s life. Murray’s lawyers claim that Jackson gave himself the final dose without the doctor’s knowledge.

Jackson’s father has since filed a wrongful death lawsuit against Murray. He claims the physician lied to emergency responders who were trying to save his son.

Child awarded $1.8M for birth injury

A Nebraska jury awarded a three year-old child and her parents $1.8 million after she suffered a permanent and debilitating injury during birth.

The child’s left arm was paralyzed after the nerves were damaged and severed when it became stuck behind her mother’s pelvic bone. Attorneys for the family say that the obstetrician pushed down on the infant’s head to release her, a move that caused the nerve damage.

A majority of the money awarded to the child, $1.2 million, is for her past and future medical bills, along with potential loss in wages due to her disability. $600,000 is for her pain and suffering and the parents received $5,000.

Man’s stomach removed due to wrong diagnosis

A 59 year-old man from Australia is suing the Central Coast Local Health District after he was wrongly diagnosed with stomach cancer.

It wasn’t until the man underwent seven rounds of chemotherapy and had 80% of his stomach removed that doctors discovered the mistake. He was diagnosed in 2009 with an aggressive form of stomach cancer. A year later a post-op evaluation revealed he never had cancer to begin with.

The man is suing the hospital for monetary compensation and is also asking for an apology. He says he has experienced emotional trauma such as anxiety and depression. He is also unable to eat while sitting down.

Women given wrong medication at pharmacy

A woman, who flew to the United States from Egypt to receive special medical treatment for a heart condition and high cholesterol, was given the wrong medication when she picked it up at a nearby Walgreens.

The woman complained of being unable to sleep, severe malaise, and a quickened heartbeat. It wasn’t until four days later that a relative saw the label had someone else’s name on it, despite the fact that the receipt had the correct information. She got another person’s medication for the diuretic Bumetanide.

She was able to contact the man to whom the prescription belonged to and found out that this was not the first time he received the wrong medication from that Walgreens. Luckily, the woman is back on her right medication and has recovered from the effects of the other drugs.

Nurse pleads no contest to abuse charges

A 45 year-old man has plead no contest in court this week to charges of abusing a patient at the nursing home he worked for.

In 2010, an elderly man was taken to the hospital with suspicious injuries. The hospital then filed a complaint with the police department after the patient said he had been abused by a nurse. An internal investigation conducted by the nursing home and also a police investigation led to formal charges of abuse.

The nurse has been sentenced to two years probation and two years suspended sentence. He has been ordered to take anger management classes and must complete a hundred hours of community service.
