Family awarded $1.3 million in Erb’s palsy birth injury lawsuit

A family in Iowa was recently awarded $1.3 million by a jury in an Erb’s palsy birth injury lawsuit filed against a doctor who delivered their daughter.
According to the lawsuit, the doctor delivered a baby girl in November 2006. During the delivery, the girl’s shoulder was lodged in place, which the doctor failed to notice. He used excessive force when pulling the infant from the womb, and she suffered nerve damage in her shoulder, a condition know as shoulder dystocia or Erb’s palsy.
The girl, who is now 4-years-old, has limited use of her arm and goes to physical therapy to undergo treatment for her condition. The ruling included damages for permanent injuries, loss of childhood consortium, and pain and suffering.
