A 59 year-old woman went in for her annual mammogram and gynecological exam a few years ago and was told her Pap smear was normal, but didn’t hear back about her mammogram. Thinking that no news was good news, she thought nothing of it.

The next year she went in, her physician asked why she hadn’t come in the year before since her files did not contain mammogram results. It turned out that her doctor had the same last name as an orthopedic surgeon at the same medical center. Her files sat on his desk for a year and showed that she had breast cancer.

The cancer had spread to her chest wall and she underwent chemotherapy and radiation, but still had to have a lumpectomy and a mastectomy. She filed a lawsuit against the medical center and was awarded an undisclosed settlement.

 An Indiana family has received $13 million after a lawsuit proved that Dr. Mark Weinberger was guilty of not diagnosing a patient with lung cancer. This ruling has come seven years after the victim died from the cancer.

During the course of the trial, it was found that Weinberger, as well as his medical team, purposefully delayed diagnosing the patient with lung cancer because they wanted to first treat her for other illnesses in an attempt to receive more money from the victim. After the family filed the lawsuit against Weinberger, he attempted to evade the case by disappearing in Greece. However, officers found him and brought him back to the U.S. for the trial.

Weinberger is currently facing at least 350 other medical malpractice suits.
