A family from New Jersey was recently awarded $8.5 million in a settlement after their son was injured during his birth that resulted in life-long brain damage.

According to the lawsuit against the hospital where the child was born, the baby experienced a significant drop in his heart rate while he was still in the womb, and the umbilical cord was compressed, cutting off the baby’s oxygen. Nurses in the delivery room waited half an hour before they alerted an obstetrician of the danger, who then did not arrive for another 22 minutes. Finally, the baby boy was delivered by Cesarean section, but he had already suffered significant brain damage.

Today, the boy, who is 6-years-old, is blind, cannot hold up his head on his own, has to eat through a straw, and cannot walk. The boy also often experiences seizures. The money awarded to the family will cover future medical expenses and also included emotional damages.

A family recently reached a settlement with a hospital after their son was paralyzed from the neck down from the use of forceps during his birth ten years ago.

During the boy’s birth, doctors incorrectly used a pair of forceps to get the boy out of his mother’s womb, and the forceps caused damage to the boy’s spinal cord. The boy, who is now 10 years old, also suffered neurological trauma. He has lived with a ventilator since he was born because he is not able to breathe on his own, and he requires constant care.

The amount of the settlement has not been disclosed, but it will be divided into annual payments to pay for the boy’s medical expenses.
