An Arizona woman had to go to three doctors before it was discovered that she has breast cancer.
Last October, she went in for her annual mammogram. The woman was told additional tests would be to be conducted, but was later relieved to find out that everything was fine. Her doctor’s office informed her that one of the doctors believed he found something in her exam, but later discovered it was benign. She was told the two different results were due to different regulations between states.
Unsatisfied with that explanation, she went to a third doctor where it was revealed she had breast cancer in both breasts. The woman also learned that guidelines for determining cancer is not handled by state, but is federally regulated.

Former deputy awarded $177M in negligence case

A former Jacksonville, Florida deputy was awarded $177 million by a Duval County jury this week after he suffered permanent injuries following his gastric bypass surgery in 2007.

Girl receives $1.8 million for birth injury

A young child was awarded $1.8 million by an Oklahoma jury this week after she suffered a serious and permanent injury during her delivery.
In 2008, the girl’s obstetrician ruptured and tore nerves in her shoulder after it became stuck behind her mother’s pelvic bone. The doctor then pushed down on the infant’s head to free her. A recent study by the Office of the Inspector General of the Department of Health and Human Services reveals that only 14 percent of medical errors are reported.

Wrongful death lawsuit filed over botched surgery

A Las Vegas family has filed a wrongful death lawsuit against a Colombian couple they say caused a 42 year-old woman’s death.
The couple, who do not have medical licenses, performed buttock enhancement surgery on the woman in the back of a tile store in April. The woman began having complications during the operation and died on the way to the hospital; police found her body near the North Vista Hospital in Las Vegas.
An autopsy revealed that she died from an allergic reaction to the anesthesia. The woman leaves behind a husband a two children. Authorities say the Colombian couple was in the United States on expired tourist visas. They were sentenced to more than eight years in prison for involuntary manslaughter, practicing medicine without a license, and conspiracy. They will be deported after serving their time.
Widow blames negligence on husband’s death

The wife of a deceased middle school teacher has filed a lawsuit against her husband’s physician, claiming that he failed to properly treat her late husband for hypertension.
Her husband, 50, died last January of cardiac arrest during a school ski trip. After his death, an analysis of his heart revealed that there was 95 percent blockage in one of his major arteries. According to the lawsuit, the prosecution accuses the man’s physician and the health clinic of failing to properly evaluate the man.
The suit states that the doctor’s negligence was a major factor in the man’s death and affected his chances of survival following a heart attack.
Couple sues hospital for negligence

A New Mexico couple are suing a Santa Fe hospital after the wife almost died after given the painkiller Dilaudid.
The woman was taken to the emergency room after suffering from severe abdominal pain in May 2010. While there, nurses gave her Dilaudid. Despite her worsening pain and sickness, hospital staff continued to administer the pain medication to her.
According to the lawsuit, her husband and daughter came to visit her after lunch and found her arms twitching, her face purple, her mouth foaming, and her eyes rolled back. The couple argues that the hospital staff should have been properly trained or should have known the morbidly obese are at high risk for obstructive sleep apnea that can be aggravated by narcotic analgesic medication like Dilaudid.
The woman says she suffers from severe emotional distress following her near death experience and has been unable to return to work.

Jury awards daughter $144M for birth injury

A Michigan jury awarded a 15 year-old girl $144 million for permanent injuries she suffered during birth.
The teenager’s mother filed the lawsuit in 2006 on behalf of her daughter. She believes the hospital and her delivering doctor were negligent in failing to deliver her daughter via Caesarian section and that her natural birth caused her child to suffer hemorrhaging, a fractured clavicle, and severe brain trauma.
After three days of deliberation, the jury came back with the $144 million verdict, which will be used to pay for the girl’s continuous care for the next 77 years. The hospital has said it plans on repealing the verdict, stating it believes it was a genetic condition that caused her injuries.

Veteran wins medical malpractice lawsuit

A 47 year-old veteran from Ohio has received a $275,000 settlement in his medical malpractice lawsuit against the Cleveland VA Medical Center.
In 2008, the man had surgery to remove a cancerous kidney. During the operation, two large surgical towels were left inside his body. For two months, the error went unnoticed by medical staff while the man became very sick and began to develop an abscess. A scan later showed the large pads inside his abdomen.
Later that year he had the towels removed, but the extra surgery caused an incisional hernia which lead to a third surgery. He was unable to work for nearly a year.

“Octomom” doctor’s license revoked

The fertility doctor who implanted Nadya Suleman, dubbed “Octomom” by the media, with a dozen embryos that resulted in her giving birth to octuplets, has been stripped of his medical license.
Yesterday the California Medical Board denied his legal bid to win back his license, citing numerous malpractice suits against him as well as multiple negligent acts and incompetence. The Los Angeles Superior Court judge presiding over the case says the physician broke serious medical standards when he agreed to implant twelve embryos into Suleman, when the maximum recommendation is three.
The Judge also claims the doctor is at fault for not referring his patient for a mental evaluation for wanting so many embryos at once, especially since she was unemployed, unmarried, and already had six children.
