Time Period to File a Claim
While recovering from a complication caused by a physician’s negligence, a person may require some time to sort through their affairs and reach the point at which they are comfortable to file a malpractice suit. As with many laws, there is a statute of limitations that creates a time limit for an injured individual to file a claim against a doctor for the injury he or she has suffered.

Limitations in New Jersey
According to the law, the state government establishes their own guidelines for how medical malpractice suits may be pursued. In the state of New Jersey, this means that the statute of limitations may not be the same as those of other states, and may include special rules or protections. Specifically, the following time limitations exist for would-be claimants in the state of New Jersey:
- Two years following the discovery of an injury
- If a minor, two years following the child’s 18th birthday
- If connected to birth injuries, before the child’s 13th birthday
- Two years following a wrongful death
While the law is generally set at two years following the discovery of an injury, this must also be measured according to when a person could be reasonably expected to notice that injury.
