Time Period to File a Claim

Limitations in New Jersey

According to the law, the state government establishes their own guidelines for how medical malpractice suits may be pursued. In the state of New Jersey, this means that the statute of limitations may not be the same as those of other states, and may include special rules or protections. Specifically, the following time limitations exist for would-be claimants in the state of New Jersey:

  • Two years following the discovery of an injury
  • If a minor, two years following the child’s 18th birthday
  • If connected to birth injuries, before the child’s 13th birthday
  • Two years following a wrongful death

While the law is generally set at two years following the discovery of an injury, this must also be measured according to when a person could be reasonably expected to notice that injury.
